Why death certificates need a sworn translation for Spain

Death certificates issued abroad must be apostilled and translated into Spanish by a sworn translator to be accepted by Spanish courts, notaries, and civil registries. Whether the process involves inheriting assets in Spain, updating a widow's or widower's civil status, or handling a nationality application, a foreign death certificate without a sworn translation will not be accepted.

Spanish authorities require that translations be produced by a translator officially appointed by the Ministry of Foreign Affairs. A standard or certified translation does not meet this requirement.

Does the apostille need to be translated too?

Yes. If the death certificate has an apostille, the apostille page must be included in the translation. Spanish courts and notaries read the apostille as part of the document package, and leaving it out can result in the document being rejected.

If the apostille is not yet in place, the translation can still begin. The final package submitted to Spanish authorities should include the full apostilled document with its complete translation.
